WHAT A BAND SHOWDOWN: OFFICIAL RULES
1. NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. MUST BE A MISSOURI OR ARKANSAS RESIDENT. ENTRANTS UNDER THE AGE OF 18 MUST PROVIDE CONSENT TO PARTICIPATE FROM PARENT OR LEGAL GUARDIAN. Entry in this contest constitutes acceptance of these official rules.
2. HOW TO PLAY & WIN. Beginning June 20th, 2012 and through July 8th, 2012 KY3 Inc., Youngblood Auto Group, and Ozark Empire Fairgrounds will ask local music artists to submit an original song they have written and recorded by uploading an mp3 audio file or QuickTime video of a performance of the song to mywhataband.com. All submissions must be original material for which the submitting artist or band owns all copyrights. Cover songs or compositions containing sampled music or lyrics will be disqualified. Each artist or band may submit one entry. On July 9th, 2012 a maximum of 14 semi-finalists will be chosen by a panel of What a Band contest judges. Semi-finalists must be able to participate in a live concert July 14th, 2012 on the lot of Youngblood Kia. Video of each band’s live performance from the July 14th concert will be posted on mywhataband.com for public voting from July 18th through July 24th, 2012. The three bands who receive the most votes will be named finalists and have the opportunity to play on the KY3 Grandstand Stage at The Ozark Empire Fair, July 28th, 2012. After all three bands have performed, audience members will vote via text for their favorite band. After the ten minute voting window has closed, the band with the most text votes will be crowned the What a Band champion and will receive $1,000, four hours of rehearsal time at Panama Rehearsal Studios in Springfield, Mo, and the opportunity to be considered by Youngblood Automotive and the Ozark Empire Fair for appearances in future Youngblood Automotive and Ozark Empire Fair commercials.
3. CONTEST SCHEDULE AND AWARD OF PRIZE. Contestants can submit their entries from June 20th, 2012, through July 8th, 2012. On July 9th, 2012 a panel of What a Band contest judges will select a maximum of 14 semi-finalists. Semi-finalists will play live at Youngblood Kia on July 14th, 2012. From July 18th through July 24th, 2012 the public will vote for their favorite band at mywhataband.com based on video posted of the July 14th performances. The three bands who receive the most votes will be named finalists and will have the opportunity to play live at The Ozark Empire Fair on July 28th, 2012. Audience members at the July 28th, 2012 concert will text to vote for their favorite band. After the ten minute voting window has closed, the band who receives the most text votes will be selected as the winner. The prize consists of $1,000, four hours of recording time at Panama Rehearsal Studios in Springfield, Mo. and the opportunity to be considered by Youngblood Automotive and the Ozark Empire Fair for appearances in future Youngblood Automotive and Ozark Empire Fair commercials. Prizes are not transferable and cannot be redeemed for any cash value, substitutions or cash equivalents. KY3, Inc., Youngblood Auto, and Ozark Empire Fairgrounds reserves the right to make rule or contest changes without notice at any time and reserves the right to change the aforementioned contest date without notice.
4. TO VERIFY AND REDEEM PRIZE. KY3, Inc., Youngblood Automotive, Ozark Empire Fairgrounds and related sponsors are not responsible for any circumstances that may occur, hindering a potential winner’s ability to claim Prize. Prize winners will be subject to verification and must make themselves available for such verification or will be subject to forfeiture of the Prize. Prize winners will be required to show photo identification and proof that the participant is 18 years of age or older, or participants under the age of 18 must provide consent from a parent or legal guardian.. All entrants must warrant that they own the copyrights to the winning composition and must agree to grant KY3, Inc., Ozark Empire Fairgrounds and Youngblood Automotive a no-fee, non-exclusive license to broadcast the composition in any and all media and by any means throughout the world in perpetuity. If a winner cannot or will not meet the terms of the agreement, another winner will be chosen from the remaining qualifying entries.
5. CONDITIONS OF PARTICIPATION. Logging on to mywhataband.com to enter the contest is solely the responsibility of the participant. Semi-finalists must agree and be able to play a live performance on July 14th, 2012 at Youngblood Kia in Springfield, MO and must agree to have their music posted on mywhataband.com for public viewing and voting. Finalists must agree and be able to play a live performance on July 28th, 2012 at the Ozark Empire Fair. Difficulties entering the contest or difficulties attending or performing at mandatory concerts are not the responsibility of KY3, Inc., Youngblood Automotive, Ozark Empire Fairgrounds or any other related sponsor. Inability to attend or perform at mandatory concert dates will result in disqualification. In any event that a band cannot attend and must be disqualified, judges reserve the right to select an alternate band. By participating, you agree to abide by and be bound by these Official Rules. The decision of KY3, Inc. management and all related sponsors in the interpretation of these rules is final. By participating, persons agree to be bound by the decisions of the judges and the official contest rules, and agree not to institute any kind of litigation or other claims against KY3, Inc., Youngblood Automotive and Ozark Empire Fairgrounds or any other related sponsor for anything related to or touching upon the contest. If a winner is found in violation of these rules, he/she may be required to forfeit his/her prize. Participant waives the right to assert as a cost of winning any prize, any and all costs of participation, verification and redemption to travel to redeem said prizes and any liability, which might arise from redeeming or seeking to redeem, said prizes. Semi-finalists will be required to provide photo identification and proof that they are 18 years of age or older, or if under the age of 18, Semi-finalists must provide consent from a parent or legal guardian. Failure to provide proof of age or parental consent will result in disqualification. Semi-finalists will be required to sign a music license release, warranting their ownership of copyrights to the winning composition and granting KY3, Inc., Youngblood Automotive and the Ozark Empire Fairgrounds a no-fee, non-exclusive license to broadcast the composition in any and all media and by any means throughout the world in perpetuity. By submitting a potential winning entry, you agree to the use of your name, address (city & state) and or photograph, videotape or any likeness for advertising and publicity purposes and to the use of statements, oral or written, made by or attributed to you relating to KY3, Inc., Youngblood Automotive, or related sponsors any and all rights to said use, all without further compensation. Prizes may not be transferred nor redeemed for any cash value, substitutions or cash equivalents. Prize winners will be solely responsible for applicable taxes, fees, licenses, or levies on prizes. Grand Prize winner must complete and sign a W-9 form. A 1099 form will be issued to the winner and submitted to the IRS for the fair market value of the prize.
6. ELIGIBILITY. Participation is open to Missouri and Arkansas residents only. Persons in any of the following categories are NOT eligible to participate or win prizes. (a) Persons who are employees of KY3, Inc., Youngblood Automotive, Ozark Empire Fairgrounds or related sponsors, their subsidiaries or their franchises; employees or agents of services agencies or independent contractors of the above organizations. (b) individuals engaged in the development, production, or distribution of materials for this promotion, and (c) persons who are the immediate family of, i.e. mother, father, sister, brother, daughter, son, or spouse, regardless of where they live, or who resides in the same household, whether related or not as any person in the preceding categories.
7. CONTEST. KY3, Inc., Youngblood Automotive and Ozark Empire Fairgrounds will conduct the contest in a manner deemed appropriate. All decisions are final.
8. ODDS. The number of eligible entries received will determine the odds of winning.
